TCU not being covered under warranty

So John did not call me back, however Tyler did again. They are still not going to pay for the TCU. However they did commit to correcting all other items on my C/S list when I dropped the car off which included lots of trim components and steering wheel and body alignment squeeks rattles and speaker issues. as well as they are still replacing the HV battery with a new one and all the new stuff connected to the battery. So I sent them 6 extra large pizzas from Barros. So when they are eating the pizza juuuuuuuust maybe they will split the costs with me or offer me something. Perhaps hats or bottles accessories something... hahaha I will keep you all updated.

I still dont quite understand their logic on this one... But with all the other items committed to.... I am not too pissed off.

I will update you with all the corrections they made once I get my car back.

What a completely nuts thread. Crazy stuff.
Seriously dont let this discourage you from getting a Lucid... For the most part they have been really good. It is a "Policy" we all know what it is like when you go up against those... If they cover everything else on my list truly I win. The only thing they could have been better at in my mind is TELL ME UPFRONT. I mean.... this obviously isnt the first time this has happened. It has happened a couple times on here. So help me "brace for impact" tell me 30 days ago that this was going to be an issue or even MIGHT be an issue. Don't tell me this now and say "Well we had to diagnose what was going on so we couldn't tell you for sure back then"

Set correct expectation.

The car is wonderful. The drive is amazing.
The range is great and once everything is fixed the car will be everything I want.

Are they going to at least updated the vehicle software?

This makes no sense to me

oh yes..... I would assume they are updating the UX at the same time.

I am still doing the major service the CCC v2 update and now the TCM. everything else is warranty.

It sounds like the TCU issue is a direct result of neglect by the prior owner. As unfortunate as that is, it's an obligation that was ignored by that owner. I also purchased my Air GT used and one of my key stipulations was ensuring that all software was up to date. Given how dependent these cars are on software it is as critical as verifying that an engine has been properly maintained. And just like a motor on an ICE vehicle, you can't hold the manufacturer responsible if an owner doesn't provide basic maintenance. And software updates are about as basic as the maintenance gets on these cars.

The good news is that Lucid has been very good in honoring warranty issues on my vehicle. I've had it in a few times now for what I would consider to be fit and finish issues. Essentially things that were not quite right when it left the factory. In each instance the fixes have been covered at no cost.

I would almost agree.... accept... the man who I purchased from was 83. The car had 6800 miles and no indication that service was needed. There was no warning sign or anything that said "I need service. There was no nag that there needed to be an update completed. So I can imagine an older guy thinking that he doesnt need to service until the car is at 10,000 or 12000 miles. if there was no nag to update (because the TCU failed... which I have found out it didnt fail it just has been locked out of the new lucid server for failure to update but alas no prompt to update) HOW WOULD AN 83 YEAR OLD KNOW IT NEEDED IT??

If there is no nag for service no nag for update how is it reasonable to assume he needed it.

Heck I didnt know that the car had not been to service until after I bought it and due to privacy laws LUCID COULD NOT TELL ME UNTIL I OWNED IT.

Anyway.... I am going to get mad again they are not covering it. So I just want to see it as a blip... and hopefully they figure out how to make it right some how.

Theoretically wouldn’t they need to prove that the software updates were offered to the vehicle and refused by the owner?
It's the owners responsibility to maintain their software. It's explicitly required by the warranty. And the car and/or app will alert you to software status and required updates. If there's an argument to be made that software updates were never offered that argument belongs to the original owner. Whether its oil changes or software updates there's a responsibility that goes along with car ownership.

A car this technologically advanced, owned and rarely driven by an 83 year-old man, should have been your first red flag. And confirming which version of software the vehicle is operating on takes seconds. This is an ownership failure, not a Lucid one.

Well I did.... the first day I got the car. I contacted Lucid to update ownership. I then asked them to please push the update, at that time they said you will need to take it into a service center to update because they cannot update it. So within days I had contacted Lucid...

And My friend.... You are telling me that I should NOT HAVE PURCHASED THIS CAR WITH 6800 miles from an 83 year old... BECAUSE HE IS 83? That somehow that should be a red flag? Get real.

Interesting turn... Tyler just text me saying that the battery that they are replacing mine with is a used battery. NOT REMANUFACTURED NOT NEW USED.... This is not going well at all. I am so confused right now. I am trying to be cool... I am trying to be calm. JOHN THE SERVICE MANAGER said they were putting a "Brand new Battery" in my car. We even talked about where they are getting it from. He said it is a new part from the Phoenix Parts warehouse.

The irony in all of this is that you've pointed out the former owners age as being noteworthy. And yeah, it's not surprising to me that someone that age wouldn't realize that software updates are a critical part of the ownership experience particularly if they weren't driving the car much. Your surprise at realizing the software was out of date could have been avoided before you acquired the car and contacted Lucid.

I'm by no means suggesting that you shouldn't have bought the car, but you seem to believe that you should get some warranty consideration because it was owned by an 83 year old man.

It’s great that you consider it a win that they are fixing items under warranty that they are required to fix per that very warranty. They aren’t doing you any favors at all, and in fact are screwing you by giving you a reman battery and charging you for the TCU.

This thread is confusing - why can’t they just start updating the software version by version until they get you current? If I don’t update my iPhone it doesn’t break - I just might not have all the current features, but I can still update it later.

Weird. Maybe cancel that pizza order.

They already ate the pizza....

Even @marqie sent me a DM quoting the warranty verbiage. Which I came to grips with.... and was slowly trying to give them the benefit of the doubt and get over it. Now to find out that they are replacing with used battery. vs what they said when I dropped it off. "You are getting a brand new Battery"

Which btw no one said in the 30 days it took to get the appointment nor in the 30 days they have had the car there. In fact, Tyler said "I am not sure if it is logistics or on hold for the connector for the newer battery technology. I believe it is where the issue lies." and many times "No new information regarding the battery pack we are on a "Parts hold".

I want to chime in here. I agree ot is the owners responsibility to update and to stay up to date but the car shouldn’t color the truth and say it’s up to date when it’s not. Did this happen here?

When I took ownership from the prior owner there was no "service required" or "please update" or any warning. I only learned by research here my neighbor who worked for lucid UX team and online that I was on old software. I didnt know that the client never did service until right before I took the car in for my appointment.
