Read a recent post where someone bought 20,000 $5 7/17 calls yesterday for .30 cents that now trading over $5 each. $600k to $10 million. Maybe it was the Alfonso guy lol.
I was lucky to get in to get 500 more at $2.92 (adding to my now 6000 share position). Wish I'd grabbed more at that price, but still kinda gun shy after the last 8 purchases on the way down. 😵‍💫
 
SEC can't get him but Portugeese libel laws seem to be more restrictive than in the USA (where the bar is very very high). Information was gotten from a quick google search using "libel laws in portugal" as the search term (I've found that most EU countries have much more strict libel laws than in the USA)
Given the choice most companies would prefer their home venue in pursuing litigation. But that assumes that you can establish jurisdiction over the defendant and have them appear in court. It’s a doubtful scenario.

So that leaves the court in Portugal. Going that route means dedicating resources to hire Portuguese counsel and retaining US counsel on a coordinating basis. That’s a time consuming and costly effort. You then have to consider the probability of a US company succeeding in a Portuguese court. You’ll also need establish damages. While the stock price dropped precipitously following the news, it also recovered in a matter of hours after the damage was mitigated. Perhaps the full extent of the harm won’t be realized for months. But even in that scenario there will have been so many intervening events that it could make it impossible to link the damage to yesterday’s report.

And if you can overcome all of the above and are successful will you be able to obtain a meaningful judgement? At a minimum you have to cover millions in legal fees. Will a judge or jury award that or render a small symbolic judgement? Finally if you do get a meaningful judgement will you be able to collect anything from the defendant?

The cease and desist letter serves the purpose of telling the offender, “don’t do it again.” It also signals to others that you mean business. And perhaps it calms shareholders and customers. That’s about it. And more importantly Lucid needs to focus on getting their cars right, improving customer service, and achieving profitability. Because while the stock may have recovered the jury is still out on the business.

CarBuzz should get a cease and desist letter as well, posting a lot of “ employee said this, said that” , no journalistic integrity.

It’s a topic that requires dialogue for sure. But for publicly traded companies there’s a proper venue for dialogue and that’s the earnings call. Lucid was compelled to respond yesterday given the impact the announcement had on the stock price. But a company has to be very deliberate in releasing information regarding their strategy given the reliance of investors on that information. Hence the filing of yesterday’s 8-K. Companies are regulated in what they do or say for reasons that are not often understood by casual observers.
 
Well they just replaced the entire leadership team which certainly suggests they learned something.
Job cuts don't necessarily tell what they're going to do, or have learned. I'm waiting for concrete signs the championed "customer" has benefited from Napoli. Youtuber, Downshift, is coming with a video where he had to hard reset a Gravity in order to restore reverse. As long as I've been here, considering buying one, I haven't thrown dirt, myself, but in March '26, I did experience a failed HVAC system (only if you call having to exit the car, lock it, walk away for ~5-10 minutes, and then start it up again to get heat, a failure) during my 1-day GT test drive. Sample size of 2, if counting a short GGT test. Napoli had nothing to do with 3.4. Even if he did, they are not through the woods. The Chief Customer Experience role, filed by Billy Hayes, former Nissan/Stellantis, needs a base hit.

Well, Afonso is getting, at a minimum, a public shaming. The key element in my opinion is he used to be associated with promoting Chinese NIO. What a piece of work.
(BTW, kudos to Borski/admins who long ago flagged him as problematic and educated me to same. 👍)

Stock is up big today, I still think the only recourse is a massive squeeze for the 36% shorted interest that didn't cover yesterday...
 
This means nothing, he's in Europe.
It indicates Lucid is taking the defamation / libel seriously.

IANAL, but Germany (where he is based) has very strong defamation / libel laws, and an American company can absolutely sue a German resident in German courts.

Will they? Probably not. Can they? Almost certainly, provided they can show “actual harm” (which they can) and that the allegations were actually false and stated as fact (which they were).

Edit: this was all based on CARBA saying it’s in Munich, on LinkedIn. But nonetheless the same applies to Portugal.

Companies, as a rule, do not comment on rumors.

They do comment on libel, though.

Nice recovery of the plunge from the false report Tuesday and then a bonus bounce on top of it (maybe from the false report forcing management to actually come out and say something to settle down anxious investors).

But I've seen too many false moves, so I decided to sell 2000 of my 6000 at $6.67 today. I've been adding 500 share blocks on the way down over the last year to lower my average. $6.67 is above the last 4 buys so in a way it feels like I made some profit, even though I'm still way behind on the first 4000. I really didn't plan to own that many shares, I just kept doing exactly what I shouldn't do - chase it on the way down. This gave me a partial offramp so I took it. The rest I'll plan to hold long term still hoping for the home run.

DCA can work if it's well calculated and executed. Hope it works out for everyone here because down cost averaging hehe
