Yep. I posted this sentiment in one of these tax forums. Technically you can sue the IRS but in the end, their interpretation being the opposite of what you did is probably going to cause a lot of pain.

Others in this forum beg to differ. Haha. Separately, I am a lawyer, so EVERYTHING is up to interpretation in my mind.

Haha. Hope that didn’t come off as being rude. The Takings Clause comes from the 5th amendment and it’s basically whenever the government takes something from you without compensating you for it. It doesn’t really apply here, so your only redress is the ballot box.

Against the government? That would have to be under the takings clause. Good luck with that one. Against Lucid? They made it clear it was not a guarantee. They dropped the ball on not asking for 5% but there’s nothing you can do now.

I spoke with someone in sales and they said Russell is due back tomorrow. They said my black/Tahoe touring is in general assembly (VIN assigned 12/13). Seems like a good sign.
